Terms of Service

1. Agreement to Terms

By accessing or using Elocute ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Description of Service

Elocute provides text-to-speech generation services, including:

  • Converting text to synthetic speech audio
  • Voice design using AI-generated voices
  • Voice cloning from uploaded audio samples
  • API access for programmatic integration

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. You agree not to use the Service for any unlawful or prohibited purpose.

5. Voice Cloning Consent

When using voice cloning features, you represent and warrant that:

  • You have obtained explicit consent from the voice owner to clone their voice
  • You have the legal right to use the voice for your intended purpose
  • The voice owner understands how their cloned voice will be used
  • You will not use cloned voices to deceive, defraud, or impersonate without consent

We may require proof of consent and reserve the right to remove any cloned voice if we believe it violates these terms or applicable laws.

6. Intellectual Property

Your Content

You retain ownership of the text you submit and the audio generated from it. By using the Service, you grant us a limited license to process your content solely for providing the Service.

Our Content

The Service, including its design, features, and preset voices, is owned by Elocute and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

Preset Voices

Preset voices provided by the Service are licensed, not sold. Paid subscribers may use preset voices for commercial purposes according to their subscription tier.

7. Subscription and Payment

Paid features require a subscription. By subscribing, you agree that:

  • Subscriptions are billed in advance on a monthly or annual basis
  • Your subscription will automatically renew unless cancelled
  • You can cancel at any time; cancellation takes effect at the end of the billing period
  • Refunds are provided only as required by law or at our discretion
  • We may change pricing for paid plans with 30 days notice

8. Usage Limits

Each subscription tier includes credit limits and feature restrictions. Free tier credit limits, feature allowances, and usage restrictions may be changed at any time without notice. For paid tiers, we will provide 30 days notice of any changes to credit limits or feature allowances. Exceeding your limits may result in:

  • Temporary suspension of generation capabilities
  • Requirement to upgrade your subscription
  • Additional charges for overage (if applicable to your plan)

Credit Consumption

  • Credits are consumed per generation attempt based on the character count of the submitted text
  • Retrying or regenerating the same text will consume credits again
  • Failed generations that do not produce audio output are not charged
  • Goodwill credits may be issued at our sole discretion on a case-by-case basis to address quality concerns or service issues

9. API Usage

If you access the Service via our API, you additionally agree to:

  • Keep your API keys confidential and secure
  • Not exceed rate limits for your subscription tier
  • Not attempt to circumvent usage tracking or rate limiting
  • Accept responsibility for all API usage under your keys

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Generated audio will be free from defects or inaccuracies
  • The Service will meet your specific requirements

The Service uses AI models to generate audio. AI-generated audio may occasionally contain mispronunciations, audio artefacts, or inconsistent quality. Output quality can vary depending on input text, text length, and the voice used. We do not guarantee that generated audio will be suitable for any particular purpose. We recommend testing with short samples before generating longer content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELOCUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Elocute from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these terms or the Acceptable Use Policy
  • Non-payment of subscription fees
  • Suspected fraudulent or illegal activity
  • Any other reason at our sole discretion

14. Governing Law

These terms shall be governed by the laws of the United Kingdom. Any disputes shall be resolved in the courts of England and Wales.
